Dear Senators Warner and Webb,

As Virginians, we write to express our apprehension about President Obama's nomination of Solicitor General Elena Kagan to succeed Justice John Paul Stevens on the U.S. Supreme Court.

Frankly, we know very little about Solicitor General Kagan's judicial views. Solicitor General Kagan would be the only current member of the Supreme Court to come to the bench without prior judicial experience. As such, she has no body of rulings from which to form even the most basic conclusions as to her judicial philosophy. The two most recent appointees- Justice Sotomayor by President Obama and Justice Alito by President Bush - could both be evaluated on their past rulings.

What little we do know of Solicitor General Kagan's background is disconcerting. As Dean of Harvard Law School, she fought hard to keep military recruiters off the university's campus. We are concerned about what these actions say about her judicial review process as well as her views of the men and women who wear our nation's uniform.

We are writing today to ask that you to publicly clarify your position on two issues regarding the nomination of Solicitor General Kagan:

1.      Do you share Solicitor General Kagan's beliefs that military recruiters should not be permitted on the campuses of our colleges and universities?

2.      In your opinion, what does Solicitor General Kagan's amicus brief regarding military recruiters on college campuses say about her judicial review process and attitude toward the U.S. Constitution?

Virginia is home to some of the nation's best colleges and universities and it also home to hundreds of thousands of active duty and retired military personnel, as well as their families.  We are deeply concerned about the judicial philosophy of a candidate for the highest court in our land that appears to place such a low disregard for the men and women who wear our nation's uniforms.

We urge you to work with Senate Judiciary Committee Chairman Patrick Leahy and Ranking Member Jeff Sessions to get real answers from Solicitor General Kagan about her judicial views, especially her views of how the law should impact the Armed Forces.
